King’s Mall Shopping Centre, Hammersmith – Expert Witness

Graham Chase took instructions from RPC, who represent Gowling WLG LLP, to provide expert advice in respect of a claim by Sainsbury’s Supermarket Limited (SSL)against Gowlings for damages in failing to protect Sainsbury’s security of tenure on the supermarket premises in the King’s Mall Shopping Centre, Hammersmith. Graham considered the basis of claim and the report issued to him, on behalf of SSL in preparing his expert report which detailed that that as a result of the loss of security of tenure, the terms agreed on renewal were unfavourable to SSL. As part of Graham’s Expert report, he reported on the level of rent, whether the rent agreed would be effected by the loss of security of tenure, the length of the lease and whether it was possible to discount the total claim.
