Land West of Copthorne, Easement Value – Expert Witness

Graham Chase was appointed by St Modwen to provide an Expert Witness report in respect of a dispute as to the value of the easement at Land West of Copthorne. St Modwen are currently developing a mixed-use development at the subject site. This dispute arose as a result of the failure of the parties to reach an agreement on the residual value attached to the easement for access by pedestrians and cycles, and in order to proceed, in accordance with the Section 106 agreement where the consent was conditional on such access being provided, sought a determination by an independent Chartered Surveyor. Graham provided the “Open Market Value” (OMV) for the easement as stated in Rider 1 of the Option Agreement
